Florida Laws Regarding Child Support
All parents, once separated, are responsible for supporting their child or children. This is true for both mothers and fathers, for couples who are divorcing, and for couples who were never married. Support may take the form of physical custody, financial support, or a mixture of both.
Florida courts changed in 2010 the method by which they calculate child support levels. Prior child support laws required at least 40 percent of overnight stays before any reduction in the parent’s child support obligation was allowed. The current law now will allow for a reduction in child support for a parent who has at least 20 percent of overnight stays with the child. Additionally, specific consideration to parents’ income levels and other financial factors as well as the daycare, health insurance, and possible unique medical needs their children are taken into account in order to construct a child support order.
