Prenuptial and Postnuptial Agreements
A pre-marital agreement, also known as a prenuptial or post nuptial agreement, is one wherein the parties attempt to resolve issues of property division and support before their marriage, should either spouse die or the marriage terminate. A premarital agreement is commonly entered into by prospective spouses if one of the parties is significantly wealthier than the other and where there is a vast age difference between the parties.
Postnuptial agreements are agreements entered into by spouses who are currently married and intend to remain married to each other, but desire to establish property and support obligations in the event their marriage ends due to death or dissolution. Postnuptial agreements are different from marital settlement agreements, which are entered into on dissolution of the parties marriage to establish property rights, support obligations, and other matters including timesharing and support of children.
